Welcome to Abendstern Records. These Terms and Conditions ("Terms") govern your access to and use of our website, services, content, and subscription plans (collectively, the "Services"). Abendstern Records is a trademark of Dexotec Music Group SE & Co. KG.

By submitting a "Request Access" form or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Scope and Provider

These Terms apply to all users, including individuals, artists, managers, and labels, who request or use our Services.

2. Request Access & YouForm

Access to subscription plans (Free, Growth, Enterprise) is only possible via the "Request Access" form hosted on YouForm.com ("Form"). By submitting the Form, you consent to the transfer and processing of your personal data by YouForm in accordance with their Privacy Policy. Dexotec Music Group SE & Co. KG processes the data for evaluating applications, verifying eligibility, and contacting applicants.

3. Contract Formation

Submitting a Form does not constitute a binding contract. A contract is only formed after:

• Successful review of your application, and
• Signing of a separate Service Agreement with Abendstern Records.

4. Subscription Plans & Payment

• All plans are billed annually in advance, prices include statutory VAT where applicable.
• Payment is due upon activation of the approved subscription.
• Refunds are only provided if explicitly stated in the Service Agreement.
• Users are responsible for providing accurate payment information.
• Cancellations must follow the terms of the Service Agreement.

5. Intellectual Property Rights

All content – including music, audio, videos, text, graphics, logos, software – is the property of Dexotec Music Group SE & Co. KG or its licensors. Personal use is allowed; other uses require prior written consent.

6. Permitted Use

Users must comply with all laws and not interfere with the rights of others. Prohibited activities include:

• Fraudulent or unlawful use of the Services
• Unauthorized access to servers, databases, or accounts
• Uploading harmful software or materials (viruses, malware)
• Reproducing, selling, or distributing content beyond permitted personal use

7. Third-Party Services

The Form is hosted on YouForm.com, and Services may integrate third-party platforms (e.g., streaming services, social media). Dexotec Music Group SE & Co. KG is not responsible for content, privacy policies, or damages from third-party platforms.

8. Disclaimer of Warranties

Services are provided "AS IS" and "AS AVAILABLE". No warranties regarding operation, accuracy, or security are made. Use is at your own risk.

9. Limitation of Liability

Dexotec Music Group SE & Co. KG, its partners, employees, and affiliates are not liable for indirect or consequential damages, including lost profits, resulting from use or inability to use the Services. Liability applies only in cases of gross negligence, willful misconduct, or injury to life, limb, or health.

10. Data Protection & Privacy

All personal data submitted via the Form is processed in accordance with our Privacy Policy. Users must provide accurate information and consent to data processing under DSGVO. You have the right to access, correct, or request deletion of your data by contacting us.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.

12. Governing Law & Jurisdiction

These Terms are governed by German law. Disputes fall under the exclusive jurisdiction of courts in Düsseldorf, Germany.

13. Severability

If any provision is invalid, the remainder remains in effect.
